    Protecting Engineer Against Construction Delay Claims: NDC

    Abstract: The “no damage for delay clause” (NDC), often used by owners to protect against construction delay claims, can also be used to protect the engineer. Although such clauses are not a panacea, a well‐drafted NDC, along with responsible action on the part of the engineer, will constitute a formidable defense to the delay claims (real or fancied) asserted against the engineer by construction contractors.
